Any dealer selling on Ebay violates Emer’s dealer agreement. Emer does not authorize its dealers to sell new Emer products via on-line third party sites such as eBay. Therefore, it is false and misleading for an auction seller to claim to have "New" Emer brand products for sale because the seller is not authorized by Emer to sell the product on suchsites and because it falsely suggests that the purchaser will receive the full array of Emer quality and customer service (such as manufacturer's limited warranty) that consumers can expect from an authorized dealer. Thus the foregoing claims use of the Emer trademarks in a manner calculated to deceive consumers, and is strictly prohibited. Emer makes every effort to protect its trademarks, corporate logotype, label designs and various products names and ensure that others do not misuse them. Emer will not allow use of its trade name (company name), trademarks (brand names), designs or symbols by any person without its prior permission being granted by Emer. In addition, Emer is the owner of the copyrights in all pictures, text and graphics on the Emer website, the Emer Catalogue and all other Emer publications. Emer is aware that unauthorized sellers often promote the sale of Emer products by unlawfully copying some or all of these protected materials. Again, such copying is strictly prohibited by federal law, and will not be tolerated by Emer. If you have any concern about whether a particular seller is authorized by Emer you can get answers at Emers website, http://www.Emerusa.com.
Also, by United Sates Law, any business or person acting as a business cannot sell an item without stating the policies/regulations that apply with that item. For example, if you sell a Emer product as new, that item must state it does not carry a warranty from the manufacturer of that item, or the transaction is considered illegal, due to false advertising. Emer does not warranty any items sold by unauthorized dealers, therefore those policies must be stated on a item that is being sold so that a customer is not falsely lead to believe they will have a valid warrant from Emer when they need to return it for warranty.
